PNP to Summon Sampaguita Vendor Over Viral Mall Incident

The Philippine National Police Civil Security Group (PNP-CSG) announced plans to summon the sampaguita vendor featured in a viral video where she was forcibly removed from a mall by a security guard. The move is part of a preliminary evaluation to determine if there is probable cause to file an administrative complaint against the guard.

Vendor to Share Her Side of the Story

PNP-CSG spokesperson Lt. Col. Eudisan Gultiano confirmed that the vendor would receive a formal notice to appear before the Supervisory Office for Security and Investigation Agencies (SOSIA). This meeting aims to gather her side of the incident and evaluate whether the security guard performed his duties in compliance with regulations.

“What we are looking at here is whether the security guard properly and correctly performed his duty in carrying out his responsibilities,” Gultiano stated.

Clarificatory Meeting with the Security Guard

The security guard and representatives from his agency attended a clarificatory meeting with the PNP on Monday. During this session, the guard pledged to submit an affidavit within three days. If the vendor does not appear, the preliminary evaluation will proceed based on the affidavit and the account of the security guard.

Possible Violations Under RA 11917

Gultiano highlighted that the guard could face penalties under Republic Act No. 11917, also known as the Private Security Services Industry Act. This law mandates that security personnel must act courteously and respectfully while on duty. Violations may result in the suspension of the guard’s license and fines for the security agency.

“That is what is stipulated in our law, under RA 11917, that at all times, our security guards should be courteous and respectful in the performance of their duties,” she added.

Vendor Denies Syndicate Allegations

The 22-year-old sampaguita vendor denied allegations that she was part of a syndicate. She also refuted claims that she cursed or spat at the security guard during the incident.

Expressing guilt over the situation, she said:
“I want to apologize to him, and at the same time, I didn’t intend for him to lose his job.”

Mall Guard Dismissed After Incident

Following the viral incident, the mall dismissed the security guard involved. The case continues to draw public attention as the PNP evaluates the situation to ensure that justice and proper protocol are upheld.
